1. Service Description

1.1 App Overview

Daivry is a smart diary application that provides:

• Diary Recording: Multi-format input including text, photos, voice, and video
• Online AI (Pro): Cloud AI for in-depth summaries, smart Q&A, and advanced features
• Cloud Sync (Pro): End-to-end encrypted cross-device data synchronization

1.2 Service Availability

• Local features work offline without network connectivity
• Online features require a network connection and an active Pro subscription
• We will make reasonable efforts to ensure online service availability but do not guarantee uninterrupted or error-free service

2. Accounts

2.1 Registration

• An account is required to use online features
• You may register via email or Sign in with Apple
• You must provide truthful and accurate registration information
• You are responsible for maintaining account security, including safeguarding your password

2.2 Account Security

• You must not transfer or share your account with others
• If you discover unauthorized use of your account, contact us immediately
• We are not liable for losses resulting from your failure to safeguard account information

2.3 Account Deletion

• You may delete your account at any time in the App settings
• Upon deletion, all server-side data will be permanently removed
• Local diary data on your device will not be affected

3. Subscriptions and Payments

3.1 Free Features

The following features are permanently free:

• Unlimited diary entries
• Multiple notebook management
• Data import and export
• Full-text search

3.2 Pro Subscription

• Pro subscriptions are offered through Apple App Store in-app purchases
• Plans: Monthly ($1.99/month) or Yearly ($14.99/year)
• Subscriptions auto-renew through your Apple account within 24 hours before expiration
• You can manage or cancel subscriptions at any time in your Apple device's Settings > Apple ID > Subscriptions
• After cancellation, Pro features will remain available until the end of the current billing period
• Refund policies follow Apple App Store guidelines

3.3 AI Credits

• Pro subscriptions include a monthly AI credit allowance
• Different AI features consume different amounts of credits
• Unused credits do not carry over to the next month
• When credits are exhausted, AI features will be unavailable for the remainder of the month

4. User Content

4.1 Ownership

• All diary content you create (text, photos, voice, etc.) belongs to you
• We do not claim any intellectual property rights over your content
• You retain all rights to your content

4.2 Content Responsibility

• You are solely responsible for content you create and store
• You must not use the App to store content that violates applicable laws
• We do not proactively review your local content

4.3 AI-Generated Content

• AI-generated summaries, tags, descriptions, and other content are for reference only
• AI-generated content may not be entirely accurate; you should assess its suitability yourself
• We are not responsible for the accuracy or completeness of AI-generated content

5. Data and Privacy

5.1 Data Storage

• Local data is stored in your device's app sandbox
• Cloud sync data is stored after end-to-end encryption
• For detailed data handling practices, please refer to our Privacy Policy

5.2 Data Retention

• Cloud sync files are retained while your account is active, until you delete the files, disable sync, or delete your account
• Deleted local diary entries are moved to trash and permanently deleted after 30 days
• Temporary AI processing data is automatically deleted after 24 hours
• Accounts inactive for over 365 days will receive an email reminder; if still inactive 30 days after the reminder, account data will be deleted

5.3 Data Backup

• We recommend regularly backing up important data using the export feature
• We are not responsible for local data loss due to device failure, system updates, or other causes
• Enabling cloud sync provides additional backup protection

6. Acceptable Use

6.1 Permitted Use

• Personal diary recording and life review
• Reasonable use of AI features

6.2 Prohibited Conduct

• Attempting to reverse engineer, decompile, or crack the App
• Abusing AI services (e.g., large-scale automated requests)
• Interfering with or attempting to disrupt our servers or networks
• Using the App for any illegal activities
• Renting, selling, or transferring your account to third parties
• Circumventing or attempting to circumvent usage limits or security measures

7. Intellectual Property

7.1 App Intellectual Property

• The design, code, interface, trademarks, and other intellectual property of the App belong to us
• Without our written permission, you may not copy, modify, or distribute any part of the App

7.2 Open Source Components

• The App uses certain open-source software components
• These components are governed by their respective open-source licenses

8. Disclaimers

8.1 "As Is" Service

• The App is provided on an "as is" and "as available" basis
• We do not guarantee uninterrupted, secure, or error-free operation
• We make no express or implied warranties regarding suitability, reliability, or accuracy

8.2 Limitation of Liability

• To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the App
• Our total liability shall not exceed the fees you paid to us in the past 12 months

8.3 AI Feature Disclaimer

9. Changes to Terms

• We may modify these Terms from time to time
• Significant changes will be communicated through in-app notifications or other appropriate means in advance
• Continued use of the App after changes take effect constitutes acceptance of the modified Terms
• If you disagree with the changes, please stop using the App

10. Termination

10.1 User Termination

• You may stop using the App at any time
• You may delete your account at any time

10.2 Our Termination

• If you violate these Terms, we reserve the right to suspend or terminate your account
• We will make reasonable efforts to notify you before termination (except in emergencies)

10.3 Effects of Termination

• Upon termination, your right to use online services ceases immediately
• Your local data is not affected, and you may continue using the App in offline mode
